A proposed multi-unit contractors yard at 800 Ethan Allen Highway has been delayed — again.

The Planning and Zoning Commission said July 3 that the vote on contractor Larry Leary’s special permit application would be held off until Tuesday, July 17, because there were not enough commissioners present at the meeting to legally render a decision.

Two commissioners present that night, Vice Chairman Joe Fossi and Charles Robbins, recused themselves from discussing or voting on the application.

The plan to build the contractors yard was previously approved in 2015, but was overturned on appeal, after a judge ruled that the application technically violated the town’s rules on yard setbacks.

The commission voted to remove the language that led to the judge’s ruling earlier in the year. A public hearing on the application closed June 19.
